Collective agreement, social plan and works council
Alongside the law, at Holland Casino the company's own collective agreement and a social plan determine what applies in redundancy. Knowing which version applies to you makes a difference.
Which arrangements apply to you
Holland Casino has its own collective agreement, concluded with FNV and De Unie among others. For a reorganization, the social plan matters most, with arrangements on reassignment, travel time, support and compensation. The existing plan expired and a scheme for the new round was still under discussion. So ask explicitly which version applies to your situation.
The role of the works council
A proposed reorganization is put by Holland Casino to the works council for advice. That right derives from the Works Councils Act and is independent of the collective agreement. Justification and advice
Holland Casino must make an economic reason plausible and put the proposed reorganization to the works council. If many roles are affected in a short period, the rules on collective redundancy may come into play. They only require notification to the UWV and consultation with the unions once the statutory conditions are met, including where the number of intended dismissals within a working area and a set period reaches the statutory threshold.
Selection and the reflection principle
Your employer does not decide at its own discretion who must go. Where roles are interchangeable, the reflection principle essentially determines the order, subject to the statutory exceptions. The unit on which that reflection is applied follows from the organizational structure of the company and the Dismissal Regulation; at a company with several venues, that is a point of attention in itself.
Reassignment and the closure of a venue
If your venue closes, your role does not disappear automatically: it must first be examined whether there is a suitable role for you, if necessary after training and within a reasonable period. What matters is whether those other positions belong to the company or group for which your employer has a reassignment obligation under Article 7:669 of the Dutch Civil Code and the Dismissal Regulation. At Holland Casino that may mean a role in another venue.

I am a croupier. Can I simply be put in the office or in hospitality?
Another role must be suitable, given your training, experience and the nature of the work. A very different role need not be suitable as a matter of course, and you do not have to accept every offer. Whether an offer is reasonable depends on the circumstances, so have it assessed before you say yes or no.
What happens to my shift and night allowances on reassignment?
That depends on the new role and the new roster. If you work fewer or different irregular hours, your allowances may fall, even at the same hourly wage. Sometimes a social plan provides for a phase-out or compensation. Have someone calculate what a reassignment means for your total income.
Holland Casino is state-owned. Does Dutch employment law apply?
Yes. Even though the State is the sole shareholder, your employer is Holland Casino as a company. A reorganization and a dismissal therefore follow Dutch employment law, just as at a private company.
